Acceptance of these terms

These terms govern use of Marketoo (the "Service"), operated by «Registered company name». By signing in, or by connecting a social media account to the Service, you agree to them. If you do not agree, do not use the Service.

These terms work alongside our Privacy Policy, which explains what information the Service holds and how it is removed.

What the Service is

Marketoo is a private workspace in which a marketing agency plans, produces, reviews and publishes marketing content on behalf of its clients. It includes a content calendar, a client approval workflow, creative generation assisted by artificial intelligence, and publishing to social media accounts a client has connected.

It is a business tool. It is not a consumer product, it is not open to public sign-up, and it is not intended for personal use.

Who may use it

Access is by invitation only. You may use the Service only if you are at least 18 years old and have been given an account by a workspace administrator, or have been given a time-limited link by the agency to review and approve content.

You are responsible for everything done under your account. Keep your password confidential, and tell us promptly if you believe your account has been accessed by someone else.

Connected social media accounts

The Service can publish content to Facebook Pages and Instagram professional accounts. To enable this, an authorised person connects those accounts and grants the Service permission to publish on their behalf.

  • You confirm that you are authorised to grant that permission for the accounts you connect.
  • The Service publishes only to accounts that were explicitly connected, and only content that has passed through the approval workflow.
  • You remain bound by the terms and policies of Meta Platforms for those accounts. Publishing through the Service does not exempt content from Meta's Community Standards, Advertising Policies or Platform Terms.
  • You may disconnect at any time, from within the Service or from Facebook directly. On disconnection we stop publishing immediately and delete the stored credentials.

Content and ownership

Material you or your business supply — brand assets, logos, product information, briefs — remains yours. You grant us the permission needed to store it, process it and use it to produce and publish content for you, and for no other purpose.

Content produced for you through the Service, once approved, is yours to use. We do not use one client's confidential business information to serve another client.

You are responsible for ensuring that material you supply does not infringe anyone else's rights, and that you hold the licences needed for any third-party imagery, fonts or music it contains.

AI-assisted content

Parts of the Service draft captions, briefs and images using artificial intelligence. Generated output can contain factual errors, wording that does not suit your brand, or claims that require substantiation.

Every piece of content passes through review and approval before it is published, and the approving party is responsible for what is published, not the generation tooling. Do not approve regulated claims — medical, financial, legal or comparative advertising claims — without checking them.

Acceptable use

You agree not to use the Service to:

  • publish unlawful, deceptive, harassing, hateful or infringing content;
  • impersonate a person or business, or misrepresent an affiliation;
  • publish content that breaches the rules of the platform it is being published to;
  • attempt to gain access to accounts, data or parts of the system you were not granted;
  • interfere with the operation or security of the Service, or test it without consent;
  • resell or provide access to the Service to a third party without our agreement.

We may suspend access immediately where we reasonably believe this section is being breached.

Third-party platforms

The Service depends on platforms operated by other companies, including Meta Platforms and Amazon Web Services. «Registered company name» is not affiliated with, endorsed by or sponsored by any of them.

Those platforms can change their APIs, permissions, review requirements or rate limits at any time, which may interrupt or remove functionality here. We will restore what we reasonably can, but we cannot guarantee any particular platform feature will keep working.

Availability

We aim to keep the Service available and reliable, but it is provided on an "as is" and "as available" basis without warranties of any kind. It may be unavailable during maintenance, or because of faults or events outside our control. Scheduled publishing depends on third-party platforms accepting the request at the time, and a scheduled post is not a guarantee of publication.

Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, loss of business, loss of goodwill, or loss of data arising from use of the Service.

Our total liability arising out of or in connection with the Service is limited to the amount paid for the Service in the twelve months before the event giving rise to the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded.

Suspension and termination

A workspace administrator may remove an account at any time. We may suspend or end access where these terms are breached, where required by law, or where continued access poses a security risk. On termination, connected accounts are disconnected and stored credentials deleted; the retention of remaining data follows our Privacy Policy.

Changes to these terms

We may update these terms as the Service changes. When we do, the date below is updated and workspace administrators are notified. Continuing to use the Service after a change means the updated terms apply.

Governing law

These terms are governed by the laws of India, and the courts of «City» have exclusive jurisdiction over any dispute arising from them.
